It's not a bracket issue. It's a swollen transom. That shiny bolt has no gelcoat around it. The washer is recessed. The transom wood expanded from years of being wet and the surrounding wood "popped"! The brown ooze is plywood glue and wood stain. I doubt an independent surveyor would tell you...
